The City of Clayton is seeking food and beverage vendors for the 2025-2026 event season. These vibrant community events take place throughout Clayton, attracting attendees for an evening of music, food, and fun.

Use of Premise

Restaurant will provide the City the following items:

1. Vendor will guarantee and assume full and exclusive responsibility for all damages to property, fixtures, and equipment belonging to or used by the vendor at or in the vicinity of the facility if caused by its respective members, opponents, guests, or spectators during the periods covered by the agreement.
2. Vendor will comply with rules and regulations established and posted by Clayton.
3. Vendor will be responsible for placing all trash, garbage, and debris generated by the vendor in trash container(s) provided by Clayton.
4. No cooking oils or grease will be dumped into trashcans, planter areas, or the street.
5. No plastic water bottles; single-serve beverages must in aluminum. paper, or reusable containers.
6. No plastic cutlery, plates, or Styrofoam plates or containers.
7. No single-use Styrofoam or plastic containers.

Insurance and Harmless Condition

The Agreement shall require that the vendor covenants and agrees to release the City of Clayton, elected officials, appointed officials, all employees and volunteers from any and all liabilities of any kind or nature in which the right, cause of action, or claim of any kind or nature whatsoever may hereafter accrue to the vendor, its employees or agents, by virtue of the Agreement between the vendor and the City of Clayton. Vendor further covenants and agrees to hold the City of Clayton, elected officials, appointed officials, all employees and volunteers harmless from any and all claims, rights, or causes of actions or damages of every kind and nature whatsoever which may arise as a result of the Agreement between the City of Clayton and the vendor.

Vendors participating in a City sponsored event on City property or the public right-of-way shall provide the City with a Certificate of Insurance naming the City of Clayton as an additional insured on insurance policies as indicated in the City of Clayton’s schedule of Event Insurance Requirements.

 

Required Licenses and Permits
The Vendor shall obtain and maintain all applicable permits, licenses and certificates required by the City of Clayton, St. Louis County and the State of Missouri and shall comply with all laws. Required permits include:

Required permits for food sales include (in order):

• Temporary Food Establishment Permit from the St. Louis County Department of Public Health (for restaurant booth vendors)
• Fire Safety Operational Permit from the Clayton Fire Department (for restaurant booth vendors)

Required permits for alcohol sales include:

• City of Clayton Temporary Liquor License
• Missouri Department of Safety Temporary Caterer Permit
• St. Louis County Revenue Temporary Caterer Permit

Payment, Alcohol Sales, and Food Options

• Vendor must provide at least two payment options.
• If selling alcohol, vendor must check for state-issued ID to ensure customers are of legal age to purchase alcohol.
• If selling alcohol, only a professional bartender or a server who has taken a formal alcohol awareness training course can serve alcohol. This is a requirement of the City’s liquor liability insurance policy. There are numerous programs, but one free and online program offered by the state of Missouri, START (State of Missouri Alcohol Responsibility Training), is available.
• If selling food, vendor must provide at least two different meal options consisting of the main entrée/item and a side.

 

Equipment 

The City of Clayton will provide the following items per vendor station. Please note that plastic cups will not be provided to vendors. 

• One (1) 10’x10’ tent
• Three (3) 6 ft tables
• Two (2) chairs
• One (1) card table
• One (1) thermos
• One (1) hand washing station kit
• One (1) vendor event participant folder

Agree to Conditions

The undersigned having examined and being familiar with the conditions affecting the service desired to be performed, as outlined in the specifications relating to food and beverage service operation within City of Clayton, hereby proposes and agrees to perform everything required and to provide and furnish any and all labor, materials, tools, supplies, and expendable equipment necessary to provide food and beverage services in a safe, healthy, sanitary, and efficient manner, in strict accordance with the aforementioned documents to City of Clayton.
